1) Acceptance of Terms: By accessing or using Griefity, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our services.
2) Description of Service: Griefity provides users with a platform for grief support, including but not limited to access to grief counselors, support groups, educational resources, and a community forum for sharing experiences and insights.
3) Not a Replacement for Professional Advice: Griefity is intended to provide support, resources, and community for individuals experiencing grief. However, it is not a substitute for professional health or mental health advice, diagnosis, or treatment. The information provided on Griefity is for informational purposes only and should not be considered medical advice. If you are experiencing severe distress or mental health concerns, we strongly advise you to seek assistance from qualified professionals such as counselors, therapists, or healthcare providers.
4)User Eligibility: Users must be at least 18 years of age to use Griefity. By using our services, you warrant that you are of legal age to form a binding contract.
5) User Account: To access certain features of Griefity, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
6) Subscriptions: To access Griefity Plus and paid features, you will need a paid subscription. Subscriptions are managed through the appropriate app store for your device. Subscriptions can be cancelled and reinstated at any time. Refunds are not available.
7) Notifications and Emails: To keep in touch with you, we may send you information by email or via push notifications in-app. You can opt out of these notifications at any time.
87) Privacy Policy: Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you when you access or use our services.
9) User Conduct: You agree to use Griefity in accordance with all applicable laws and regulations. You also agree not to:
a. Violate any intellectual property rights or other rights of any third party.
b. Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
c. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
d. Interfere with or disrupt the operation of Griefity or the servers or networks connected to Griefity.
e. Engage in any activity that could harm Griefity or its users.
10) Content moderation: Griefity reserves the right to remove any user generated content that does not meet our content guidelines. If you are concerned about any content you see on Griefity, please report it immediately to team@griefity.com.
11) Intellectual Property Rights: All content and materials available on Griefity, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are the property of Griefity or its licensors and are protected by copyright, trademark, and other intellectual property laws.
12) Third-Party Links: Griefity may contain links to third-party websites or services that are not owned or controlled by Griefity. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
13) Disclaimer of Warranties: Griefity is provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied. Griefity does not warrant that the service will be uninterrupted or error-free, nor does it make any warranty as to the results that may be obtained from the use of the service.
14) Limitation of Liability: In no event shall Griefity, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Griefity.
15) Indemnification: You agree to indemnify and hold harmless Griefity, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your use of Griefity or your violation of these Terms of Use.
16) Changes to Terms: Griefity reserves the right to modify or replace these Terms of Use at any time. If a revision is material, we will provide at least 5 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
17) Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of New Zealand. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
